Columbus, OH asked in Child Custody and Child Support for Ohio

Q: I’ve been paying child support to my ex (never married) since he was born 15 years ago. He now wants to live w me.

We agreed that we would not go to court but she would return the payment to me for living costs, but after 3 weeks of him living with me she changed her mind and thinks “it is the right thing for me to continue to pay her” even though he is living with me. He is enrolled in my school district which is different than hers. Do I have a chance of not having to pay her? I don’t want her money, I just don’t want to pay her for him living with me. Once again, we were never married. Will I have to take her to court? I can’t afford an attorney to fight this and I am married with two other children, so I have a more stable household than she does as she works evenings as a waitress.

A: You are legally obligated to pay the child support until a court changes it. If you don't, legal action could be taken against you to collect. If you do not have legal custody, then enrolling him in your school district might be a problem, or even getting medical treatment for him. You need to find a way to retain a local family law attorney to review all the facts and advise you. Use the Find a Lawyer tab.
