Q: What are California State laws in regards to a business and how much light is needed after dark outside ?

My son and I were at Camelot (an arcade business with small rides and amenities outside) we were waiting in a poor lit area for an employee to come to begin operating a ride for them. While waiting my son walked into a rail maybe at 50' high and slipped in a puddle of water where their were no signs up and slipped hitting the back his head. As well as the front of his face from hitting the rail. I informed the manager that it was a poorly lighted area and he said that the state of California cleared them for business a month ago . I would like to know what are the laws in regards to lightening needed outside for a business to operate ?

A: When the manager said the Sate "cleared them for business," that doesn't mean that they can't be sued for the failure to detect and cure a hazard on their property. It sounds like the lighting was bad enough to be called a hazard, and should at a minimum have had barriers or signs put up in that area. I don't know how badly injured your son was, but if it is bad enough you can sue the company for negligence. I have not seen the sight of the accident, so I can't tell how good your chances are, but I would pursue it with the claims manager of Camelot, and force the issue to be handled by their insurance carrier.
