Q: My workers comp lawyer is sending a hearing representative for my msc hearing is tHat bad for him to do ?

they said he is sending his hearing representative to my mandatory settlement case hearing wouldn’t it be better if he was there with me ?

i assume you are having a Mandatory Settlement Conference for your civil court and your lawyer is bringing someone from WC case?

i think you should ask him why he is doing it?

A: It depends. Every piece of evidence you plan to show the judge at trial must be written out at the MSC, or you cannot show it to the judge at trial. Every penalty due to you and every issue you want the judge to decide needs to be written on the statement of issues as well...if this paralegal doesn't write that you are due penalties for late TTD or late PPD payments, your attorney cannot get them at trial. IF this 'legal assistant' has never been to trial and misses something , it isn't likely the attorney will tell you, because it means the attorney failed to adequately supervise this legal assistant. If I'm paying attorney fees, I would insist the trial attorney be present at the MSC. If things are botched by a legal secretary practicing law without a license at the MSC, a real attorney may not be able to fix it at trial.
