Q: Can a school give records and my contact information to my ex-husband if he has no custody and I have full custody?
He originally had 50-50 custody but didn't want to pay child support so when we went to finalize our divorce he offered to sign his custody over as long as I didn't take him for child support. It has been almost 5 years that he hasn't seen our son and he has never paid any support. I have full custody of our son and he has no visitation. I found out that he has been calling the school and impersonating my now-husband as well as threatening the school stating they were refusing him access to his child the excuse the school gave me for giving him my contact information and our sons records was that they had to give it to him because he's on the birth certificate and it doesn't matter that I have full custody also my son was being abused by his father and xxx to being hospitalized in a mental hospital for two weeks the last time he saw his father almost 5 years ago and the school knows this they also know that I have had to have multiple restraining orders for domestic violence
A: If he hasn’t communicated or attempted to communicate with your son for over six months your husband can adopt the child without his father’s consent. Give me a call and I’ll be happy to discuss further.
