Q: My son was injured at school by a substitue teacher. Do i have a case
A: I don’t practice in Georgia, but no one picked up your question for two weeks. I hope your son is okay. Based on the facts at hand, it isn’t possible to say. You should consult with a Georgia attorney. In the very least, you should learn about the deadlines, notice requirements, and statutes of limitations you would need to act before to protect your/your son’s legal rights. If it is a public school, there could be notice of claim requirements in the order of days. I can’t speak for Georgia, but public schools, departments of education, school districts, villages, towns, cities, and other public entities in general could be protected by short notice of claim requirements. An attorney would likely have questions as to what happened and how the injury arose, in terms of did the substitute teacher/school act in a way that was negligent, egregious, or in violation of a regulation, among other issues.
