Dallas, TX asked in Criminal Law and Civil Rights for Texas

Q: If my indictment says 124th district court.... Why am I going to court in the 188th district? Dismissable?

It is a 2 year old charge and I have not even talked to my lawyer in a private setting

A: The state must only have you in the correct county, the particular court is not fatal to the state's indictment if it has you in district court for a felony or county court for a misdemeanor (filed by information, not indictment). Also the statute of limitations for many felonies is 3 years so your within that time as well. Sorry.

A: Call your attorney's office and schedule a sit-down meeting to discuss the case progress, especially the evidence that the prosecution has provided during the discovery process.

The indictment probably just says the Grand Jury was impaneled by the 124th District Court. That doesn't mean the case can only be heard by the 124th. Just worry about the evidence and get busy assisting your attorney in the defense.
