Houston, TX asked in Criminal Law for Texas

Q: Will I get arrested or police just won't consider this case

had a fight with my ex and after arguments on 9-9-2018 I changed the view of her security camera but I was caught on cam doing that. On 9-10-2018 I vandalised her car but not caught on cam snce I changed the view of cam. She said she made a police report against me with video proofs. But no one contacted me it's a week already. I worry what will happen ? Will police arrest me or is that proof not enough ??

A: Just because your ex filed a police, don't expect anything to happen soon. Unless it is an emergency situation, where the police believe you are going to cause immediate damage, the processing of the police report will take time. Most likely the police will turn the report over to a police detective who will review the case, and may seek more information. If the detective believe the law has been broken and they have evidence and probable cause, they will then send the report to the prosecutor’s office. The prosecutor will, at that point, look at the report and determine if there is sufficient evidence to prosecute you. If there is sufficient evidence to prosecute, a judge will issue an arrest warrant for your arrest.

A: Expect to be charge with a property crime like Criminal Mischief. The severity of the crime will depend on the cost to have it repaired or replaced. Do not talk to any officers about this case. You should also stop posting about it online because these are fairly unique circumstances and this is a public website.
