Q: I requested p.m.co. to provide copy of our original check in/out doc and maint. requests they said no

Went to office yesterday and asked for copy of original lease and check in/ out sheet, as well as print out of maintenance requests. We lived there 4 years and I'm having a heck of a time finding some of my docs. Receptionist said she can't access those docs it has 2b a mana. So i made an appointment4 today. She emailed and said no she will not meet with us and made no mention of the requested docs. She did say we need to send everything else certified mail from now. Can she do this. They have been nightmare.?

A: Be careful here - you may be being set up. First, a landlord must allow a tenant to inspect and if they pay for the copying costs, make a photocopy of their lease within a reasonable time of being requested. Be sure to put your request in writing and either hand deliver or mail it to them, keeping a copy and being sure it is dated and signed. That is all a tenant is legally allowed to required from the landlord unless/until a lawsuit is filed - then you can demand a copy of your entire file. Most landlord's will comply with the request and certainly don't want to have to deal with a lawsuit just to turn over what they already have easy access to.

That part that concerns me about your being potentially set up is the comment about sending everything certified mail. Any/all legal notices required by landlord-tenant law are expressly required to be sent by regular first class mail - NOT certified. If send Certified only, it is the same as never having sent it at all. Further, there presumably is no need to mail anything but to rather just personally hand it to the on-site manager or to someone in the office. If you do, ideally have a witness or at a minimum note the date, time, and who you handed it to. Good luck.
