Q: In Louisiana, I'm seperated for 3 months, trying to buy a house to put a roof over kids head. (Currently staying w pare

Abusive marriage, have need to get kids into a home, 365 day rule here for divorce involving kids, found a house and under contract, but didnt know they'd have to use his credit, even tho were seperated, was told by loan company to have him sign a separation of property agreement, which i thought hed be glad to do, but he now sees as a new form of control over me n kids. Trying to make it where were forced to move back to his house. (Living with my parents since he kicked us out the last time and parents are trying to sell soon so need house empty) what can I do since hes refusing to cooperate? If I just filed thru court and had him served, how many days would he have to respond before a default judgement. I'm not asking for anything from him regarding my part of community property just a signature stating that from date of separation forward the property regime is terminated.
