A: If this is a private mediation, outside the court system, the mediator should declare the mediation unsuccessful and give you a report to that effect. If there is a contract, it should specify the next step, usually arbitration. If no contract, you could file a suit in court.
A: There is generally no time limit on a mediation, however, at some point it will become apparent that the mediation is going nowhere. At that point, the parties should agree to end the Mediation. There is no point in going on if you are not getting anywhere. Good Luck.
