Q: Is there a difference between medical malpractice and regular negligence?

A: I do not practice in Maryland but your question remains open for four weeks. The underlying concept is essentially the same. It is based upon the existence of a duty, a breach of that duty, injuries/damages, and a causal link between the breach of duty and ensuing injuries. Medical malpractice can involve other legal theories as well.

A: In Maryland, the biggest difference is the hoops you have to jump through to bring a claim in malpractice cases that are required by the statutory scheme that covers our malpractice claims. But the gist of malpractice is the same as negligence.
