Q: Will I be able to use an emergency situation defense?

I have an 8 year old daughter who is highly allergic to bees. She was stung by a bee 20 miles from the nearest hospital. She waited ten minutes before telling me she was stung by a bee. I had epi pen for her but I did not think I could use it ten minutes after the initial sting. My boyfriend was driving 88 mph in a 55 mph speed area to the hospital. No one called 9-1-1 and no one called the hospital. A cop got behind us 4.5 miles from the hospital and turned on their lights and sirens trying to stop our vehicle. We did not stop for the cop and continued to the hospital. My boyfriend circled the cop in the front parking lot and the cop got over the pa and yelled at him to stop the car. We then went to the emergency room without stopping for the cop. Outside the emergency room. The cop issued my boyfriend a speeding citation (88 in a 55). Can he use an emergency situation to get out of the ticket?

A: Your boyfriend is fortunate that all he received was a speeding citation; he could have received criminal charges. Given the circumstances, though, and the fact that he wasn't criminally charged, it may be worth his while to obtain local counsel and request a formal hearing on the citation to see what can be worked out.
