Q: DUI Suspended License

In June of 2012 I was pulled over by Monterey Country Sherrifs I was only supposed to get an infraction for Swerving in the road. The Officer said that he was going to let me go and not get my vehicle towed to call a licensed driver to pick up my car. I was very honest with him in regards to having my license expired. He then proceed to his unit to run my name and verify license and registration for my car were up to date wich they we're. The car was registered to me and I was also the policy holder of the insurance. As he returned to give me the ticket to sign he went to my passenger side door and I opened the window at this point he slightly was flashing his flashlight towards the back seat. I had purchased two tall can beers for my nephew and they were unopened in the plastic bag that I got at the gas station I purchased them at. He immidiately asked me to step out of the car and put my hands behind my back and called CHP for a sobriety test. I need immidiate help

A: It's hard to answer your question because you really aren't asking a question. If you were arrested for DUI then you should consult a lawyer as quickly as possible since you have rights that will "expire" within 10 days of your arrest. Despite the fact that your license is expired you can reinstate at any time (unless you are suspended, in which case you have to clear up the suspension before getting your license). It seems likely the stop for swerving was the grounds for the initial contact and you provided the officer with additional information which ultimately led to an investigation for DUI and then your arrest? A lawyer can help you protect your rights regarding the DUI suspension of your drivers license and then help you in court too.
