Madison, AL asked in Child Custody for Alabama

Q: I am confused on my updated custody modification paper work

I have been granted sole legal and physical custody of all four of my children. Their mother must exercise her visitations through family services center. At the end of the section it says, The provision for child custody in this order of modification by default constitutes a custody decree or custody determination under the Alabama enactment of the Uniform Child Custody Jurisdiction Enforcement Act Ala. Code 30-3B-101 Furhter this court's Parenting Clauses attached herto as Exhibit A is incorporated herein by references and made a part of this decree as it is set in full. On the next page it has Exhibit A in one of them it says Regardless of the custodial/vistiation schedule, a parent shall be allowed to eat lunch with a child at school; provided that all applicable school rules and requirements should be followed. I am confused if they have supervised visits, why be allowed at school? Can someone help me understand?

A: Many courts have standard provisions they put in all Orders. The Exhibit A is an example of that sort of document. The court retains jurisdiction over your case for 30 days allowing you to file a motion to alter amend or vacate the order. Since the provision in question contradicts the actual Order you would probably be best served. by filing a motion to alter or amend the Order to strike or clarify that portion of the Order.
