Q: Recent buyers of deceased mother's property fails to recognize my easement of ingress and egress over such property.

Absentee landowner (Countrytyme Land Specialists, LTD) plans to develop recreational hunting cabins around my residence and causing undue stress and fear. My expense of driveway upkeep and homeowner's insurance will increase exponentially. What are my rights as an easement holder? The land specialist company has brought complaint in Common Pleas court with unfounded claims. No $ for a lawyer, just paid over $2k in maintenance on driveway and bridge that I developed in 2004.

A: If the company filed the lawsuit to assert their easement claim, then the court will hear the evidence, and make a decision. If you do not respond in the lawsuit to oppose its claim, the court could simply approve the company's claim to easement rights.
