Q: two people are charged with criminal damage to property one pled guilty they other has evidence pled not guilty an win

The judge saw my evidence and told the DA they didn’t have a case so they dropped the case but they still trying to make my boyfriend pay 5000 restitution for criminal damage to property can they do that
