Q: If a person has a 1st time shoplifting charge and is now in pa and in rehab can that person. Be pulled from rehab

A: It's hard to figure out exactly what the underlying circumstances are behind your question. Is the charge from another state, but the defendant now resides in PA (or at least is here temporarily for drug rehab)? I'm going to presume so.

No, I don't think the defendant will be yanked out of rehab for a minor charge in another state. What will likely happen, however, is that the defendant could be found guilty "in absentia" (meaning, without him/her being present in court), or the court could issue a bench warrant for his/her failure to appear, or both. Best bet is to let the court know the defendant is in rehab somewhere and get a postponement of any court date. I've had this situation many times, and courts are typically sympathetic in such cases and will grant a postponement. The key is to keep in touch with the court and don't blow off court dates.
