Wyckoff, NJ asked in Traffic Tickets for New Jersey

Q: What's the chance I'll go to jail if I am charged with 2C : 18-2A (1) and 2C : 17-3A (1)

I was in a abandoned building but I wasn't doing anything. My friend was damaging the place and my other friend was telling him to stop.

A: Everything depends on what you did and your prior criminal record. First time offender programs exist which can definitely help you avoid jail, BUT the prosecutor can deny entry in to them and Burglary one of the crimes you are charged with is a common crime to be denied entry into PTI for. Get yourself a good lawyer and you always have the best chance of avoiding jail. Most of us criminal lawyers offer a free in office consultation, I suggest you set one up ASAP.

A: Depends on your record and your co-defendants and what you were doing and the victim and the prosecutor and the Judge and maybe the police officer and certainly your attorney and you. If you have no record and a decent lawyer then it wouldn't be difficult to convince all the parties involved to give you a break or worst case scenario a bite of the apple.
