Q: If my dad was killed while on work release duty from prison, can I file a wrongful death claim or will the fact that he

is incarcerated preclude a lawsuit?

A: It wouldn't preclude a lawsuit but a lot would depend on how things happened. For starters, if he died on the job there would be a likely a death benefit. If he was working before being inside there would be a social security death benefit. Suggest you contact a member of the Texas Trial Lawyers Assn for the county where it happened. They give free consults.
