Q: My divorce is final, My ex has yet to remove my name from the mortgage and refinance

I have been divorced for a while and she was given 30 days to refinance. My attorney advised that she could be held in contempt and she still has not refinanced the home. I also put a large portion of my 401k into the house and then left that job. I want my 20,000 grand from the home, and want my name off the mortgage as it is affecting my credit. She is constantly late and I would like to move on with my life and get a home with my fiance'. What can I do to force this and get my money.

A: As your attorney suggested, you can file a petition for contempt for her failures to abide by the court order.

My question to you, however, is: why are you asking questions here when you already have an attorney, and have already asked the same question to him/her? If you trust your attorney, then follow his/her advice. If you don't, find a new attorney.

A: Follow your attorney's advice, which is probably to file to have her held in contempt and force her to comply with your agreement or order.
