Regarding what the insurance company "says", nothing is 100% definite until there is a signed document setting forth the agreed-upon settlement arrangement. On the other hand, if there is at least a written representation of their promise, such as a letter or email from an insurance adjuster, the odds are that they'll stick to that representation.
