Savannah, GA asked in Car Accidents for Georgia

Q: I was involved in a Accident,and the other driver was found to be at fault at the scene.

His his "at fault" status is pending his appearance in Traffic Court. I gave the officers my Insurance Information and Driver License at the scene,but had a friend pick me up,due to the fact I was driving on a suspended License with a failure to appear. before the cops could question me. They called me and asked me to pick up my Insurance and Driver License later that evening,but I told them I was unable to at that time.This happened in Savannah Ga. Will I be able to file a claim if he is found to be "at fault" in Traffic Court? What if his ticket is dismissed? Thank You.

A: Yes. You may have driving on suspended issues but he's still at fault. If his case is dismissed then you still have a claim though it may have less weight. If you were hurt consult a member of the Ga. Trial Lawyers Assn for the county where it happened--they give free consults.

A: If the ticket is dismissed, there may still be information in the police report that could be relevant. Since accident attorneys work on a contingency basis, you should be able to find an attorney in Georgia to contact for a free initial consultation.
