Q: Can my landlord still evict me if my 5 day notice was taped to my door with an incorrect amount balance shown past due?
I am a former employee of the leasing office where I currently live. I fell behind 2 months after having an emergency c section 6 weeks before my due date. I was selected for section 8 housing after being on the wait list for 8 months. The owner would deduct half of my rent from each paycheck and was responsible for our online rent ledgers. I was denied housing assistance because she had not input my last 4 months of rent prior to my surgery and told the housing authority i had a balance past due when I was still current on my rent. I had a 5 day taped to my door saying I owed $1700 more than I actually was owed. Their lawyer told me 3 weeks ago, she would ask the owner if i could start paying off my balance now that i was working again & then after getting my financial aide reward from school, i would pay ahead on my rent. We accept financial aide as a form of income as it is a college town. I haven't been able to reach her since and was served a court summons for eviction tonight.
A: Any advice I give you about the legality of this action is meaningless unless you have a lawyer to represent you in court. Hire an attorney immediately! Check to see if your college has a legal aid office that can help. Bring copies of your rent receipts (or payroll records if it was deducted from your pay) to show what you've paid to the first appointment with your lawyer.
