Hacienda Heights, CA asked in DUI / DWI for California

Q: I blew through a breathalyzer, but was not told what my BAC level was? the same thing happened at the station

I was stopped for a suspicion of drunk driving at 3:30 am. I had a mixed drink at 11:00 pm and two beers after that. I felt completely sober (and I do understand how alcohol could still be in your system even if you don't feel it). I thought I passed the sobriety test since I did everything perfectly, but the officer said that my "eyes twitched a little....its hard to fool the eyes when you got perfect balance" when he shone the light on them. He then told me to blow on a breathalyzer, and I asked what my BAC level was but he said not to worry about it..which sounds a little off. He took me to the station and, again, I blew on another breathalyzer and was not told it was over 0.08..without being specific. They then registered me for a DUI and I stayed at the station for a couple oh hours before being released. I just thought the whole situation was off. How do you think I should deal with this?

A: You should contact a local DUI Defense Attorney to discuss the facts and possible defenses. Many DUI Defense lawyers offer free consultations, if you were sober and did well on the field tests a lawyer should be able to use that to your advantage.

BASED ON YOUR VERSION THAT THERE WAS MINIMAL DRINKING YOU SHOULD DO OK.

HOWEVER, NOTE IT IS NOT THE NUMBER OF DRINKS BUT RATHER THE AMOUNT OF ALCOHOL IN THE DRINKS THAT MATTERS.
