Q: If a landlord is going to bring corporate in to my home to look at code violations do they need to give me 24hrs notice

So there is structural failure in my floor and 9 other violations in my home.the landlord sent me an email just now at 7 PM telling me that tomorrow corporate is coming into my apartment to look at them. Can she do this without a 24 hour notice with me at work?

A: Unless you either requested a repair or agreed to the entry, the landlord must provide at least 24 hours advanced notice before entering your home. Further, unless there is a specific provision in your written lease allowing it, email is likely not a valid way to give you 24 hr notice anyway. This said, you are free to post a note on your main entrance door telling them not to enter if you wish and if they enter anyway (and you can prove it) it likely would be worth a month's rent to you, plus your court costs and attorney's fees. Of course if she enters anyway without at least 24 hours notice, you likely are entitled to the same damages if you can prove it. So it likely comes down to how likely will it be that you can prove either possible entry and whether trying to keep them out by denying entry with your note is more important than trying to retroactively sue them in court for a month's rent. If you do need to sue in court, this is the sort of case many landlord-tenant attorneys would consider taking on a contingency wherein you would not owe them anything for their fees beyond the initial evaluation interview; rather they would rely upon collecting their fees from the landlord upon prevailing or settling the case. It also is the sort of case that most landlords (but definitely not all) would settle quickly because they don't want to have to pay for your ever escalating attorney's fees to quibble when they know that you have them dead to rights.
