Q: My landlord never put weatherproofing on my door for 4 years.my electricity bills have been so high am I owed a %ofmybil

So it’s cold in wint er hot in summer and all heating and cooling is thru electricity.

My bills have always been sky high and I never figured it out until a guest commented on the draft! There’s no weatherproofing around the door! I have been heating and cooling the outdoors which is why my apartment is never a comfortable temperature and my bills are high.

So do you lay knowing that my apartment was never weatherproofed when they rented it to me and hasn’t been the whole time oh me a percentage of the electricity bills I’ve been paying for over four years now?

A: You may have a claim but it is a bit unclear. The statute requires that the dwelling have "effective waterproofing and weather protection of roof and exterior walls, including windows and doors". Does weather protection mean just keeping the rain out or does it include drafts as well? Ultimately, that comes down to what a Judge or Jury decides if you cannot informally reach an agreement. The other thing you should know is that any claim arising out of a rental agreement or Oregon's Residential Landlord-Tenant Act is limiting to damages during the prior 12 months - i.e. there is a one year statute of limitations on those claims. So even if you were entitled to damages for the last 4 years, the most you are likely to be able to get in court is the previous one year.
