Jones, OK asked in Real Estate Law for Oklahoma

Q: what is best way to address property boundary dispute with adjacent property developer? Currently encroaching my prop.

Bought house last month and adjacent property developer recently placed “new” property boundary stakes in my yard and driveway. They are currently destroying the greenbelt between my home and yard and the new development. There was no disclosure prior to closing that 55 small homes on 100’ x 50’ lots were going in adjacent to our home. The previous owner and real estate agent met me at the property several times prior to closing and we walked the property boundary. The previous owner showed me the West boundary as it is closest to the house. The developers “new” property boundary stakes are considerably closer to my home and driveway than the property boundary the previous owner pointed out. New boundary literally 3 foot from my house and into my driveway. The house and driveway were built in 2004 and have stood as is since this time. I’m concerned the developer will continue to destroy the greenbelt and further encroach upon my property.
