Q: As the child (35 yr now)never received child support from her father while living in PR can she claim the total pension?
My mother keeps telling me to claim the pension he has never paid Asume. I am 35yrs, married with kids living in FL. My question, is it possible to do? What are the steps. This case is from 1980s til 2008, in which I turned 25. Can the department of children and families in FL accept the case? Or make this as a lost case.
A: Unless your mother got a judgment before you turned 18 she probably cannot recover past due child support so many years later. Since child support was owed to the parent if you are the child you have no standing (independent right) to collect past due child support.
