Tunkhannock, PA asked in Uncategorized for Pennsylvania

Q: What kind of lawyer (area of expertise) do I look for?

We are a salvage yard that sells used diesel parts with no guarantees to the public. We had a sale where the customer said we sold a faulty engine. The local magistrate sided with the customer. We need to appeal. Neither side had representation at the magistrate-level hearing where judgment was awarded to the plaintiff.

A: Just look for someone who handles civil litigation. You'll have 30 days from the date of the magistrate's judgment to file an appeal to the Court of Common Pleas in your county (likely Wyoming County). Your local bar association may be able to point you to someone as well.

Best of luck to you.

A: Presumably you have invoices that say as is. For starters at some point have a business law attorney review your paperwork.

If this is covered through your general liability coverage you may want to notify them. Otherwise you need to file an appeal, as the other attorney said. I agree, the Bar Association in that County is where you should go.

A: An attorney with experience in civil litigation, business transactions, contracts, or related areas should be able to handle such a matter. If you sold the engine with no guarantees, or used the terms "as is," that should work in your favor, showing the absence of express warrantees.
