Q: My wife and I are going through a divorce. If she is not seeking child support will the court force it?
We share parenting and any costs that are for the kids we split minus food and housing.
A: If you and she agree on everything in an uncontested divorce, and you both have relatively equal time with the child, equal sharing of expenses, relatively equal incomes, and each can provide an adequate place to live, then the court might allow an adjustment to the standard child support calculation, so that nobody pays child support. But the court require child support, even if you both agree that none is needed. If no child support is ordered now, if any circumstances change, either parent can go back to court and ask for child support, until the child is 18 or graduates from high school.
