Asked in Criminal Law and Traffic Tickets for Minnesota

Q: The snow was on my rear windshield I am unsure as to if the charge is even correct under that statue.

I had snow on my rear windshield that does not have windshield wipers (only the back doesn't) during a snowstorm yesterday and was able to see out of all 4 side windows and my front windshield. I got pulled over and got a citation. Subd. 3.Defrosting requirement. No person shall drive any motor vehicle with the windshield or front side windows covered with steam or frost to such an extent as to prevent proper vision. I am being fine $128.00 and I could see out of my front windshield and all 4 car door windows.

A: You could call a Driver Evaluator at the Minnesota Department of Public Safety to ask if it would go on your drivers license record (moving violation). If not, then it's mainly just the fine. You could fight it on the grounds that your car does have the ability to clear the rear windshield and it was not covered in snow, except that caused by heavy snowfall. Or, ask for a reduced fine.
