Q: If I was charged with something you and they had no evidence so they dropped the charges the send a now found the charge

A: It sounds like you are experiencing a classic situation where the prosecutors and police are not on the same page and so what happens is the prosecutor ends up dismissing the charges.

At a later time, the prosecutor then brings back up the charges and you are once again stuck in the same situation.

This happens for a few different reasons. Typically, it is because the prosecutors are not on the same page as the police and someone has dropped the ball. So, the prosecutor dismisses the case for legal purposes since they do not have a complete case. They are allowed to refile the charges against you as long as they do it within the statute of limitations time period.
