Ontario, CA asked in Real Estate Law for California

Q: My HOA violation notice request.

I live and have ownership in a California HOA. I recently noticed money missing from my dues account (I maintain a positive balance). I contacted the property manager and was told I have a violation fine. I told them I didn't receive a notice of the alleged violation, hearing or an outcome letter. They refused to provide a copy of the notices, the Board also. I contacted the Assoc's law firm and was told the notices are not Assoc recorders and refused to provide them as well. I think something is very fishy. How can I obtain a copy of the notices if they exist?

A: You can demand a copy of the pertinent documents from the HOA, but don't expect them to give them up willingly. HOAs are notoriously poor at giving up documents. I still suggest you demand a copy of the pertinent documents. Good Luck.
