El Paso, TX asked in Child Custody for Texas

Q: How exactly if the 100 miles calculated in custody orders and how is it determined exactly?

My question comes from my court order. It takes me 148 miles of a round trip and 4 hours of travel time to go get my son and pick him up. It’s 37 miles to arrive to the school and 37 miles back to my house and it’s the same miles when I drop off my son and come back home. My order states if the parent lives 100 miles from the residence I get more summer time and spring break vacations. I just want to know if I fall in the 100 mile category and how exactly it’s calculated. I was denied summer visitation due to being over my 30 days and I sent the letter just recently. Any help to this question is appreciated. I am the non custodial parent and I did submit a letter to her home stating the date were from june 28th thru August 4th in the summer time.

A: The 100 miles is calculated from the residence door to the residence door on a map and NOT driving distance. Let us know if you need further assistance. An attorney who provides you with an answer should really read your specific order. See that you are in El Paso. We do not service that area. However, if the order happens to be pending in our service area which is Harris County and surrounding counties give us a call at 888-343-4529. Good luck.
