Saint Paul, MN asked in Criminal Law for Minnesota

Q: Our place that we helped out at and stored some things was raided. Dates on warrant are diff from paperwork filed.

Warrant was signed 3/13/18. Says they are commanded to bring anything found and the person in whose possession and return warrant within 48hrs. My paperwork says original affdavit, search warrant, and return service were filed at clerk of court on 3/19/18. Thats over 48 hrs! Also an arrest sheet was prepared for me for keeper of drug place and paraphenalia but not completed on 3/19. I did not even speak with anyone 3/26. I was not under arrest then either, but the offence date says 3/15/18. I was not read any miranda rights about this case until 7/13/18 when i was picked up on a warrant for this that was issued a week earlier. Now how can they charge me with this if i wasnt arrested within that 48 hours?

A: Question everything. That's how we identify effective defenses. But don't share details online publicly. Instead call a criminal defense lawyer with significant experience defending drug cases. You are welcome to call me. A stale search warrant can make the search illegal. But we want to get a full picture of each and every fact possible, before settling on the best defense.
