Q: Does a NJ municipality have to recycle? If so is there a penalty if the municipality does not recycle?

With the increased cost of recycling it may not be economically or environmentally feasible to continue to recycle. As a member of the governing body of my municipality I want to know if we can eliminate the recycling program in our municipality without penalty.

This question is best answered by your township attorney that is what he is paid for and that is his job. What I will say is that, it was never a green thing to recycle as it generally cost more money and energy to recycle than the benefits gained. at least for everything except maybe paper. That's the reason China has stopped accepting American recycled products because it is creating too much pollution for them and they no longer want to be the world's dumping ground.
