Q: Does a traffic ticket need to be accurate/Does the date need to be accurate? Can the court demand, I appear verbally?
I broke down on the highway, during a real Murphy, State of Emergency. I couldn't get roadside! I sat for 30min, trying in 10degree weather, with no heat or power. I was able to finally get home. When I got home, I decided to call the police to inform them of the presence of my vehicle and the story. They informed me, it was already towed, and to come in with paperwork to retrieve it. This week, about almost 6weeks later, I received 4 tickets address to my old address, dated 2 days after the actual event. The court clerk also informed me of a warrant, that she recalled! She demanded that I appear just 3 business days later or she would get the judge to reissue the warrant! Is there a legal requirement for defendant notices? Is it legal to demand, my appearance without written notice, over the phone. I have documents from DMV, that proves my new address was updated in NJ DMV database.
A: Here is your problem MVC must have had your update for your new address before the offense occured otherwise the tickets were sent to your correct address. Yes the court can demand your appearance, you were lucky they actually even rescinded the warrant as many times this is not done unless you can prove you had not gotten the summons which is nearly impossible to do.
