Q: I had a ramp fall off my trailer on i-10 in Louisiana. A guy who slowed down to avoid it was hit. Am I liable for that?

I'm from Texas but this happened in Henderson, LA. A man slowed down to avoid hitting a ramp that fell off of my trailer. A driver behind him wasn't paying attention and rear ended him. Now there is an insurance claim from the driver that hit the guy that slowed down trying to get a payout from my insurance company. I know in Texas the driver that rear ended the other man would be at fault, but I'm not sure about Louisiana. Can I be held liable?

A: You and your insurance will be held responsible for both cars and the injuries of their drivers and passengers.

A: If a separate company handled the actual loading and lashing down of the ramps and it was something not within your direct control, bring that to the attention of your insurance carrier.
