Bogue Chitto, MS asked in Family Law and Child Custody for Mississippi

Q: Do I have rights to my children's records if I am a non custodial parent and custody papers state I am entitled to know?

records, is this allowed. ?

I am the non custodial parent, I went to my children's school today to request a copy of their records, attendance, report cards, enrollment form, etc. I provided ID. as well as my custody orders specifically showing where I was entitled to all records pertaining to them. The school would not release them to me without the mothers permission. Finally I got records, and on the enrollment form for both children, she put her current husband as my children's father. She then called to.tell me what I had done was illegal.and that I have no rights or entitlement to their records unless i go through her and that she would be calling the school to forbid me from getting anymore information. Paper work states NOWHERE in it that the records have to come from her. Is this something I can use in court.

A: It is sure. So long as it is allowed under the court order, and you have joint legal custody, you are entitled to all information concerning your children.
