Q: can i sue my realtor and the seller to pay for my roof leaking?
i bought a house 6 months ago and the first rain my roof started leaking in multiple places, when we were buying our house our realtor got a roofer to come out to look at the roof and she told us he said everything was fine, and she would send us his inspection report but never did. i contacted her and had her send me the inspection from the roofer but it didnt say anything was fine it said to replace the roof when i contacted the roofer about this to try to get my roof fixed through him i come to find out he never said the roof was fine and actually gave my realtor a bid for replacement and told her that as well. the seller also knew the roof was leaking and covered it up with paint and a diy roofing job. The seller used the wrong material for the flat part of my roof, it has shingles and is supposed to be torched down and now my ceiling in coming down. i have had 6 roofers come out and they all say the same thing that its installed wrong and cant be repaired needs to be replaced
A: Yes, based on what you have said here, you have a very strong case. Whether your matter belongs in court or arbitration may depend on your contract(s). Start contacting real estate litigators right away.
A: I suggest you sue the seller and the roofing company. And, if your realtor knew of the problem, you should sue her too. Depending on the escrow papers, you may have to have a mediation and arbitration before you can file a lawsuit. If neither party signed the clause requiring an Arbitration, then you can go directly to the Courts.
