Q: Tenant Early Termination

The home we are currently renting, lease is until September 30, 2019, is managed by a property mgmt company. The owners have sent a certified letter to the company to request termination of their contract and owners will take over as LL. I was told of this cancellation by the owner, via FB Messenger, and was informed their agreement with mgmt co. will end on May 30, 2019, but nothing would change when we signed the new contract with them (which has not been signed). This new contract goes into affect on May 31, 2019. I told the owner of the property, not the mgmt company, via FB Messenger that we have decided to purchase a home and gave our 60 day notice of cancellation which will be on June 1, 2019. When the owner received my message she went back to the mgmt company asking to retract their cancellation agreement and to have them continue with their original agreement. Is this legal and do we still owe the termination fees?

A: This will depend upon whether you have entered into a new written agreement with the owners that supersedes the prior agreement through the management company. If so, then whether you have to pay termination fees, etc. will be governed by the new agreement. If not, and the rental management company accepts the owners request to retract the cancellation of the contract, then I think your agreement through the rental management company will still be effective and its terms will govern whether you are required to pay any termination fees.
