Q: I have a friend who lives in Puerto Rico. She is married but her husband has separated from the home.
He has seperated from the home, his wife, and their daughter who is 8 months old due to his cheating with another woman and possibly another. My friend would like to come to Chicago for a couple of weeks but he keeps threatening her and telling her she is not taking the baby anywhere. She doesn't want to stay here, she just wants to visit. Please advise!
A: Hello and thank you for using Justia. She can travel for visitation purposes. If the husband denies her, she should file for divorce. I would just purchase the tickets and leave if her intent is to return to Puerto Rico. If not she can go to the court and get judicial authorization to travel.
