Q: Can a landlord evict me in Ohio if I paid my rent late and did not include on of two late fees? Fees exceed 5% of rent.

I paid my rent late via money order and included one of the two late fees I was charged (two fees of $125 for $1,225 rent are charged on the 5th and 10th). The landlord is refusing to accept my rent until the second late fee is included. I owe $1,486 and have given them a money order for $1,350. They are threatening to evict me for the remaining $136 and are refusing to apply the $1,350 to my balance. They have possession of my money orders.

A: Yes, landlord could file an eviction. It might get dismissed, but landlord can file it. If landlord files an eviction, that becomes a permanent court record, even if it later gets dismissed. That can make it difficult for you to rent from a future landlord who checks your name in the records. So try to work it out with landlord to avoid that problem.
