Q: What can I do about my new charge for possession of a controlled substance?

I was arrested at the department of Health and Human services in the parking lot, for an warrant that was issued the same day for an assault charge. I locked the doors of my friends car and I never had the keys. I was arrested and taken to jail in like 3 minutes. They searched the car with out my knowledge and supposedly found over 2 grams of meth. I was charged with it after being in jail for 2 hours. The cop investigator told me that the tow company had to take inventory of my belongings and the tow company found the drugs in the car. Then the cop told me that the necrotic team only wants names. I said I don’t use drugs so I’m sorry I can’t help you. Unfortunately now this is being used against me in CPS court when I have no criminal history not even a speeding ticket. I know I need to hire a lawyer. Can I do anything to stop them for using this in CPS court?

A: CPS plays by different rules than the criminal courts. There is an entire sub-specialty of attorneys that focus on CPS cases. Many of those are Family Law attorneys that gravitated to CPS cases via divorce and SAPCR (child custody) cases.

The practice areas are so different that you are probably best served by having two excellent attorneys who can coordinate with each other, one an expert in criminal law and the other an expert in CPS cases. A criminal defense attorney that dabbles in CPS cases might not give you the best representation in a CPS case and vice versa. A jack of all trades is the master of none.
