Yorba Linda, CA asked in Estate Planning, Real Estate Law and Probate for California

Q: My sister took out a second mortgage out on my mom's house and at the time she had dementia ? Is,am I liable or is she

Yes I do as I'm living in this house I'm very angry that I have to deal with this now especially at a time like his, also this loan is/was for $400,000.00. Please help me sort this out as I'm disabled with my hips and I have a hard time getting around. She spent this money on vacations, new cars and she said that it was for renovating the house that belonged to my mom, that I live in. She's the executer to the estate and she's mismanaged my mom's estate as far as I'm concerned. Also who has to pay this back or is the loaner liable because they didn't see my mom sign the papers and I think my sister may have forged her signature, she wouldn't even, or should I say her husband wouldn't let us see my mom. They've gotten away with alot mishandling my mom's estate, and I want to rectify this matter and if I have to go to court I will I need to know who to file a complaint to please help.

Thanks

Best Regards

Feeling like there's no hope.

A: Your sister may have commited financial elder abuse and she may be required to either reimburse the estate or have the $400,000 in loans credtied towards her inheritance. Contact a local attorney for a full consultation.
