Portland, OR asked in Landlord - Tenant for Oregon

Q: Can landlord charge an increase of $200/month and a $200 security deposit because our adult child moved in with us temp.

We took him in on the basis that he can’t stay with us long term. Because he’s been here more then 14 days, he went through the application process required by the landlord and we are now being told that he has pay $200/month more on top of what we pay and an extra $200 security deposit. Him being here does not surpass legal occupancy levels. We aren’t personally charging him rent because we want him to be able to save up for another place. Is the landlord being reasonable? None of the other renters in this situation have had to do so in the past. We are in the process of rebutting an over overcharge for broken shelves on a 6 year old already broken Crosley fridge ($385) that they decided to replace. We now feel discriminated against and this seems like a way to push us out. There is nothing in our lease agreement stating any extra charges for extra occupancy and this comes as a shock to us. Nothing of the such was ever discussed until half way through our sons application process.

A: You are not going to operate under your existing lease agreement - if you are adding new tenants to the lease, it will be a new rental agreement and sure the landlord can raise the rent or charge whatever he wishes, subject to the rent control requirements of Oregon's SB608. You don't begin to post adequate information to be able to evaluate whether this does comply or violate the new rent control statutes. Less likely, but also worth evaluating, is whether there is any sort of violation of the City Ordinances IF your rental dwelling is within the Portland city limits. Good luck.
