Hazard, KY asked in Criminal Law for Kentucky

Q: Hello I am being charged with felony theft by deception code check. I buy And sale smartphones

I have bought phones and sold them on eBay for years. This is how I feed my kids. I manage a Facebook group local of 65,000 members. Some people came to me saying if I give them $200 they can get new iPhones then bring them to me and I give them another $400 for the 2 phones. They signed a contract for service and got the phones for doing so. I told them forehand that if they didn’t pay their bill it would hurt their credit and I couldn’t be responsible for that. Now 5 people have signed statements against me. I’m not sure of their statements but the warrant says I give them money to get the phones after they signed their contract they came to me for the rest of the money and got the more cash. That is true but where is the deception how can I be charged with this?

A: You need to hire a competent criminal defense attorney to look into this for you. From what you’ve described, it doesn’t sound like there was any theft or fraud, but all the facts need to be considered.
