Q: Can my friend fight eviction from the home that his grandma bought for him to live in after her passing?

His grandma bought house for her and her grandson to live in and for her grandson to keep after she passed. Six months ago the grandmas daughters came to home with armed security guards and two members of local law enforcement and requested that the grandmother went with them. She agreed stating she did not want to upset them by arguing. Since her removal from home their has been zero contact with her and all requests made to her daughters to speak to her have been denied. The grandson has filed a missing persons report with local authorities which has not been followed up on by them at all. Now the grandson has received an eviction notice with his grandmothers name as the plaintiff but he has text messages from his aunt that show she is in charge of what is going on. The entire time since the grandmother was removed from the home the grandson has continued to be given an allowance from the her of approximately $300. What should the grandson do? Court date is three days away.

A: Evictions are a matter of contract or implied contract. This will turn on the exact reason in the Notice given as to what Grandson's defense may be. Grandson may have a defense that he is an owner and thus cannot be evicted.

He should consult an attorney to discuss the facts and possible defense before the court date.
