Sunset, LA asked in Family Law and Child Custody for Louisiana

Q: If a hearing officer's recommendation is appealed, does that mean that recommendation is in effect now?

Last year, my sons grandmother was given sole custody of my son with me having visitation. We went in front of a hearing officer last week, and she recommended joint custody with me being domiciliary parent. I appealed the recommendation due to me wanting sole custody and next court date is in July. Does this mean the old judgement, her having sole custody and me having every other weekend visits, is still in effect, or the NEW recommendation, me having joint custody and domiciliary parent, is in effect? Just trying to clear this up. I believe the NEW recommendation is in effect even though I appealed it, which made it temporary until court. Please help me out with this ASAP!! I'm doing this all on my own, can't afford a lawyer at this time.

A: A change in custody recommendation is not enforceable if it has been appealed. A change in visitation is enforceable if it has been appealed. Hire a custody lawyer.

A: Custody of your child is a very serious and potentially permanent issue. You should retain an attorney to represent you for this issue as soon as possible.
