Q: What do I need to do to get my mother's house transferred into my name so we can sell it? Cuyahoga County, Ohio

The house is the only thing in her estate. Everything else had beneficiaries listed and has been distributed. There was no will and no executor named. My wife and I took care of her the last 3 years of her life. She has no outstanding debts except for back taxes and penalties owed on the house that have accumulated after her death.

My mother died in April 2016. Hers is the only name on the deed. We let her boyfriend live out his life there. He died at the end of March 2019. They were not married. Her name is the only name on the deed.

I have had investors look at the house. They all say that it is worth $20,000 in the condition it is in. It is my understanding that this falls under the Ohio Small Estate terms.

Her descendants are my brother, my sister, and me. My brother is in prison and my sister has dual citizenship in Korea so she is out of country a lot.

The three of us are looking for the simplest, and cheapest, way to close out her house and sell it.

A: You can file with the probate court to be the administrator of the estate using the process for a small estate. The probate forms are on the court's web site, and court personnel might help you a bit. But they cannot give legal advice. So if you have questions on what to do, they can't help.
